Marleen is partner Intellectual Property & Technology and head of the Healthcare & Life Sciences sector group at the Dutch law firm La Gro, based in The Hague, The Netherlands. Marleen has more than 25 years of experience in conducting complex (cross-border) patent proceedings. Since the Unified Patent Court (“UPC”) came into being, she has represented various clients in UPC proceedings regarding pharma and medical devices.
Specialised in patent law, she handles matters in all fields of technology, involving mechanical engineering, telecoms/high tech, chemistry and life sciences. For example, she represented clients in relation to ship shutters, floating solar panels, LTE & 4G/5G SEPs and FRAND issues.
Marleen has achieved international recognition in the field of life sciences She is worldwide regarded an authority for her in depth industry knowledge and experience in the life sciences, including litigation and advice on patents, SPCs and PEs regarding pharmaceutical products and medical devices. Also, she represented these clients and advised them in regulatory issues (orphan drugs, data exclusivity, NAS, first marketing authorisations) and product liability.
Marleen has acted as lead counsel in multiple (cross border) patent/SPC proceedings and has advised and represented clients like Amgen, Stada, Bayer, Insud Pharma in respect of a great many blockbuster drugs, both small molecules and complex molecules (biosimilars).
In recent years, she has litigated and advised on many patent/SPC and regulatory issues concerning medicinal products containing (es)omeprazole, alendronate, escitalopram, glatiramer acetate, trastuzumab, zoledronate, rivastigmine, ezetimibe+simvastatin, pemetrexed, sitagliptin, deferasirox, DMF, fingolimod, nilotinib, eculizumab, aflibercept and on CRISPR-Cas technology. Marleen advises clients in negotiating and drafting e.g. licences and cooperation agreements.
Pro bono work
For more than 15 years Marleen pro bono advises the NeoKidney Foundation on all the patent related issues and other legal aspects of the development of an artificial portable kidney.
