The Dutch courts in The Hague (holding exclusive jurisdiction in patent matters) have long been instrumental in shaping European patent case law. Highly respected for their well-reasoned decisions, they are famous for granting cross-border (preliminary) injunctions. Our patent litigators, through years of experience, have made a significant contribution to this cross-border practice. At some point this practice has been restricted by decisions of the Court of Justice of the EU (‘CJEU’). Recently, however, it has seen a resurgence. On 25 February 2025, the CJEU handed down its groundbreaking decision in BSH Hausgeräte v. Electrolux, allowing the national courts of EU Member States to grant cross border injunctions for infringement of European patents and exercise long arm jurisdiction, despite a possible invalidity defence.
It goes without saying that if clients need strategic advice or hands on assistance in effecting or resisting cross-border patent enforcement, we are the logical choice, whether this concerns the Dutch Courts or the UPC.
In the high-tech and telecom sector, we mainly assist international clients (right owners and implementers) in disputes over SEPs, with a focus on 4G/5G technologies. We conduct nullity and infringement proceedings and assist in licence negotiations on FRAND terms, combining technical expertise with legal decisiveness.
